Agreement to Receive Text Messages 

By providing your mobile telephone number and affirmatively opting into any SMS or MMS messaging program offered by MountainTop Affiliate Network Inc. (“MountainTop,” “Company,” “we,” “our,” or “us”), you expressly consent to receive recurring automated and/or non-automated text messages from MountainTop at the mobile telephone number provided. 

Messages may include account-related communications, affiliate network updates, advertiser and publisher communications, campaign-related information, compliance notifications, platform updates, educational content, newsletters, service announcements, support communications, promotional messages, and other communications relating to MountainTop’s services, programs, platform features, and business activities. 

Your consent to receive SMS communications is voluntary and is not a condition of purchasing any goods or services, participating in the MountainTop Affiliate Network, submitting information, or accessing our website or platform. 

By opting into SMS communications, you represent and warrant that you are the authorized subscriber or customary user of the mobile telephone number provided and that you have authority to provide consent to receive communications at that number. You further acknowledge that you understand SMS messages may be sent using automated technology where permitted by applicable law. 

Messaging Technology Disclosure 

You acknowledge and agree that MountainTop may utilize automated messaging platforms, customer relationship management systems, communication management tools, application programming interfaces, and other messaging technologies to send SMS and MMS communications. 

Such technologies may include systems capable of sending automated text messages, managing communication preferences, processing opt-in and opt-out requests, maintaining consent records, and supporting compliance with applicable laws, including the Telephone Consumer Protection Act (“TCPA”), Federal Communications Commission (“FCC”) requirements, CTIA messaging guidelines, wireless carrier requirements, and applicable state laws. 

Program Description 

MountainTop operates SMS messaging programs designed to provide relevant communications to individuals who have requested information, created an account, interacted with MountainTop, participated in affiliate or advertiser programs, subscribed to communications, or otherwise provided consent to receive messages. 

Messages may include, without limitation, affiliate account communications, publisher or advertiser updates, campaign notifications, platform announcements, compliance notices, customer support responses, educational information, newsletters, promotional communications, and other messages related to MountainTop’s products, services, and business operations. 

The content and frequency of messages may vary depending on your relationship with MountainTop, your communication preferences, your activity within our platform, requested information, applicable campaigns, and operational requirements. 

Message Frequency 

Message frequency may vary depending on your interaction with MountainTop, your selected communication preferences, the type of communications requested, and the services or programs in which you participate. 

Subscribers may receive recurring messages based on their enrollment and communication preferences. Message frequency may increase or decrease depending on account activity, campaign participation, compliance requirements, operational updates, and other legitimate business purposes. 

Message and Data Rates 

Message and data rates may apply according to your wireless carrier’s applicable pricing plan. MountainTop is not responsible for any fees, charges, taxes, or other costs imposed by your wireless carrier or telecommunications provider resulting from participation in SMS messaging programs. 

Opt-Out Instructions 

You may opt out of SMS communications at any time by replying STOP to any text message received from MountainTop. 

After submitting a STOP request, you may receive one final confirmation message confirming that your request has been processed. Following confirmation, no additional SMS messages will be sent unless you provide new consent to receive communications. 

Supported opt-out keywords may include STOP, END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, or STOP ALL where supported by the applicable messaging platform or carrier. 

Opting out of SMS communications does not prevent you from receiving other communications that may be permitted under applicable law, including email communications, account-related communications, contractual notices, customer support responses, or other non-SMS communications.

Carrier Disclaimer 

Wireless carriers are not responsible for delayed, failed, misdirected, or undelivered messages. 

SMS messaging is subject to effective transmission by wireless carriers and network availability. Messaging services may not be available on all devices, carriers, or geographic locations. MountainTop does not guarantee uninterrupted delivery of SMS messages and may modify, suspend, or discontinue messaging programs when necessary for operational, legal, compliance, or technical reasons. 

Changes to Mobile Number 

If you change, deactivate, transfer, or otherwise discontinue use of the mobile telephone number provided during enrollment, you agree to update your information with MountainTop or discontinue enrollment using that telephone number. 

MountainTop is not responsible for messages sent to reassigned, recycled, or transferred telephone numbers where you have failed to provide updated information or properly discontinue enrollment. 

Consent Records and Compliance 

MountainTop maintains records of SMS consent and communication preferences in accordance with applicable laws, regulations, industry standards, and carrier requirements, including the TCPA, FCC rules, CTIA guidelines, and applicable wireless carrier messaging requirements. 

Consent records may include the mobile telephone number provided, date and time of consent, method of consent collection, website URL, landing page information, consent disclosure language presented at the time of enrollment, IP address, device information, browser or user-agent information, session information, source information, and SMS communication history. 

MountainTop may maintain these records directly or through authorized third-party service providers for compliance purposes, auditing, recordkeeping, dispute resolution, fraud prevention, and management of SMS communication programs. 

Privacy and Data Use 

Your participation in MountainTop SMS messaging programs is governed by the MountainTop Affiliate Network Privacy Policy. 

MountainTop does not sell, rent, lease, or exchange mobile telephone numbers, SMS opt-in information, or consent records with third parties for their own independent marketing purposes. 

MountainTop may share information with trusted service providers that assist with operating its communication programs, including SMS providers, telecommunications providers, hosting providers, customer relationship management platforms, analytics providers, fraud prevention providers, compliance providers, and other technology vendors. 

These service providers are authorized to process information only as necessary to provide services on behalf of MountainTop and are contractually or operationally restricted from using such information for their own independent marketing purposes. 

Program Modification or Suspension 

MountainTop reserves the right to modify, suspend, or discontinue any SMS messaging program at any time, including changes to message content, frequency, enrollment methods, eligibility requirements, technology providers, or communication procedures, subject to applicable law. 

Disclaimer of Warranties 

SMS messaging services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by applicable law. 

MountainTop does not guarantee uninterrupted availability, error-free operation, continuous delivery, or compatibility with all mobile devices, carriers, or networks. 

Limitation of Liability 

To the maximum extent permitted by law, MountainTop Affiliate Network Inc., its affiliates, owners, officers, directors, employees, contractors, service providers, licensors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to participation in, inability to participate in, or interruption of any SMS messaging program. 

To the maximum extent permitted by applicable law, MountainTop’s total liability relating to SMS messaging services shall not exceed one hundred dollars ($100.00). 

Governing Law 

These Mobile Messaging Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles.
